Conflicts with the Ministry of Internal Affairs

  • On May 1, 2011, Anatoly Shariy shot twice at a visitor to a McDonald's diner in Kyiv. According to Shariy, while he was having dinner with his wife, an unknown person approached him and began to insult him. When the journalist asked him to calm down, he suggested going out to “sort it out.” On the street, Shariy shot him twice with a traumatic pistol, hitting him in the leg and stomach. Shariy, who called the police himself, was detained and the pistol was confiscated.

On June 16, Shariy’s colleague, journalist Alexander Chalenko, Advisor to the Minister of Internal Affairs Konstantin Stogniy, informed that the head of the Main Directorate of the Ministry of Internal Affairs of Kyiv, General Krikun, was personally tasked by Minister Mogilev to “resolve the issue with Shariy” in order to prevent the writing of further negative materials about the UBNON Ministry of Internal Affairs.

Investigation of the “Aloyanov case”

On June 29, 2011, Shariy publishes the first part of the investigation into the murder of the owner of the 4room supermarket, in which he accuses the leadership of the Ministry of Internal Affairs, represented by the minister and his deputy Vasily Farinnik, of receiving a bribe of $1,500,000.

On June 29, 2011, Shariy released an operational video of the Ministry of Internal Affairs, in which Artur Aloyan, a representative of the well-known Aloyan clan in Ukraine, ordered the murder of a Kyiv businessman. Also in the material, Shariy claimed that Russian citizen Merab Suslov, who was brought to justice for the murder of businessman Shabab Aloyan in 2009, is innocent. Shariy accused the leadership of the Ministry of Internal Affairs of Ukraine, represented by the Minister of Internal Affairs Mogilev and his deputy, Major General Vasily Farinnik, of releasing Artur Aloyan as a result of the Ministry of Internal Affairs receiving a bribe in the amount of $1,500,000.

On September 21, 2011, Shariy published the material “The Ministry of Internal Affairs of Ukraine and the Yazidis. Millions in blood. Part 1”, in which he again accused the top of the Ministry of Internal Affairs of the fact that Merab Suslov, accused of murdering the owner of “4room”, was in detention illegally. On the same day, case No. 09-22896 about the attempt on Shariy’s life is closed, and a criminal case is initiated against the journalist himself under Article 383 Part 2 of the Criminal Code (for “staging an attempt”).

Assassination

On July 12, 2011, at 3:30 a.m., a few hours after the incident in the underground casino, when Shariy and the film crew of the 1+1 channel were locked in the premises by escaped workers, a shot was fired at Shariy’s car on Radchenko Street. As a result, the windshield and rear window of the car were shot through, the interior lining of the car was damaged by shotgun pellets, but the journalist was not injured. Employees of the Solomensky District Department of the Main Directorate of the Ministry of Internal Affairs of Ukraine in Kyiv, journalists from the 1+1 channel, representatives of the prosecutor’s office and the Main Directorate of the Ministry of Internal Affairs arrived at the scene of the incident. An operational investigation team with a dog handler arrived at the scene and spent several hours unsuccessfully searching for traces of the criminals and weapons. Journalists from the 1+1 channel were on site and filmed the search for weapons. As soon as the journalists and Shariy went to the police department, the police found a sawn-off shotgun. Shariy refused to write a statement and admit that he was a victim. On the same day, an investigator from the Main Directorate of the Ministry of Internal Affairs of Ukraine in Kyiv took away the keys to a car from the journalist, which was blocked in the parking lot of the Solomensky District Department of the Main Directorate of the Ministry of Internal Affairs of Ukraine in Kyiv. Criminal case No. 09-22896 was opened into the assassination attempt on the journalist. The head of the press service of the Kyiv police, Vladimir Polishchuk, put forward a version according to which Shariy “only wanted to scare him,” since the shooting began when he had already jumped out of the car.

On July 14, 2011, the case of the assassination attempt was taken under the personal control of the President of Ukraine Yanukovych, Deputy Prosecutor General Kuzmin and Minister of Internal Affairs Mogilev. Shariy's interrogations lasted 6-10 hours; on July 15, fingerprints and DNA samples were taken from him.

On July 19, a search was conducted in the apartment of Shariy’s mother and his wife’s apartment. Investigators are seizing memory cards and SIM cards of mobile phones. The front door was surrounded by police, who did not allow either lawyers or Shariy’s colleagues from the 1+1 channel to enter the search site.

Two days later, the Ministry of Internal Affairs sent out another release to the media, in which it said that on December 20, Shariy’s case was transferred to court.

Version of the Ministry of Internal Affairs about the staging

On October 5, 2011, the Public Relations Department of the Main Directorate of the Ministry of Internal Affairs of Ukraine in the city of Kyiv sent out a press release to the media entitled “The attempted murder turned out to be a staged act.” The release alleged that Shariy staged the assassination attempt. On October 6, Shariy was supposed to attend a round table on freedom of speech, with the participation of President Yanukovych. However, Shariy's invitation was canceled. The Ministry of Internal Affairs claimed that his fingerprint was found on the cartridge that remained in the barrel of the gun from which the shot was fired at Shariy’s car. At the same time, he cannot provide this evidence, since after the imprint was transferred to tape for sending to the Research Center of the Ministry of Internal Affairs of Ukraine, the imprint on the cartridge was destroyed. On October 27, Shariy published an open letter to the Minister of Internal Affairs Mogilev, in which he directly accused him of pressure.

Criminal prosecution

In Ukraine, two criminal cases have been initiated against Anatoly Shariy:

On June 29, 2011, Shariy was handed a resolution to initiate a criminal case against him under Article 296 (hooliganism) of the Criminal Code of Ukraine - for the shooting on May 1 at a McDonald's fast food, when Anatoly Shariy twice shot rubber bullets at an unknown person who allegedly attacked his wife.

Hello Poroshenko

Chaika and Butkevich did not hide their joy at the loud revelation, but the rosy mood quickly passed. All the information announced turned out to be fake, as stated in my blog told Shariy himself. He showed how he had been corresponding with Chaika since December 2016, sending him photographs. He, in turn, didn’t even bother to check them and believed every word of the unknown user. “Imagine if this happened in France. The president has his own channel, and on its air two offended journalists publish the personal information of a blogger, whose crime is only that he criticizes this very government, the same president, and dared to criticize the channel and, in particular, these two offended . Can you imagine what will happen in France? Because France is a civilized state, but what we are dealing with is an uncivilized state, absolutely limitless, laws don’t work there, nothing works there at all,” Shariy summed up.

Lenta.ru: Anatoly, was it important for you to check the professionalism of Channel 5 journalists?

Shariy: On the one hand, this is Poroshenko’s personal channel; he himself has spoken about this more than once. On the other hand, this channel constantly spreads fake news. They fell through the cracks a long time ago, I constantly pointed out lies on their broadcasts, but they didn’t even remove it from their website. I'm fed up with their nonsense and insanity, their lack of professionalism. So I decided to show them their level.

Do you connect the dismissal of Yuri Stets with this scandal?

Knowing Poroshenko’s hysteria, I can imagine what kind of scandal he caused in his administration, how Stetsya scolded him. They talk about health problems. I think that after Poroshenko’s hysterics, these problems became such that there was no other way out but resignation.

How do you generally assess the work of Ukrainian journalists?

This cannot be called journalism. This is a lie, propaganda, zombieing of people. Anything but journalism. Any dissenters, any alternative opinion is denied, labeled as a “Kremlin agent”, “agent”. Ukrainian journalism has sunk to the bottom; it simply doesn’t exist. There are some people who treat their business conscientiously, but in general it looks unprofessional and unscrupulous. People earn their money and don’t even think about what they are getting into.

International organizations talk about improving the situation with freedom of speech in Ukraine. For example, in April the Reporters Without Borders ranking was published, where the country rose five places. What is this connected with?

International organizations are as far from Ukraine as the Decembrists are from the people. They notice only what they want to notice and do not see what they do not want to see. In reality, Ukrainian prisons are filled with those who made some incorrect repost on social networks. The media are afraid and do not themselves talk about oppression. A typical situation is when some more or less independent channel begins to sound the alarm, talks about pressure, and after a couple of weeks it already broadcasts exclusively distilled news about the successes of the authorities.

I am under the protection of the Office of the High Commissioner for Refugees (UNHCR), I can also contact the intelligence services of European countries. At the end of the day, I can take care of myself. This is not the first time my personal data has appeared in the public space, I have received threats, but I see no reason to be afraid. They're just bastards, it's a shame to be afraid of them. Besides, in Europe you still can’t just come to a person and start performing something. Here they will be put in the same cell with the Arabs for life, everyone understands this.

Despite leaving Ukraine, Anatoly has Ukrainian citizenship. In one of the videos, the man said that it creates a lot of problems for him, and therefore Shariy does not understand why this country sometimes threatens people that it will take away their citizenship. In response, the journalist proposed to deprive him of such a connection with the Ukrainian state.

In February 2017, Anatoly filed a lawsuit against Detector Media for a publication that discredits honor and dignity. In the article, the publication called Anatoly Shariy “the mouthpiece of the Russian world” and “a scandalous Ukrainian pseudo-refugee.” Both the district court and the appeal court rejected the blogger’s claims.

In the summer of 2017, lawyer Mark Feigin accused Shariy of committing a crime of a sexual nature on radio “Moscow Speaks”. Anatoly denied this rumor and sued the lawyer. The court granted this claim. The blogger received compensation and a retraction.


In 2018, the court deprived Mark Feygin of his lawyer’s license: the man allowed himself to use obscene language on social networks towards colleagues and their clients.

In 2011, Shariy Anatoly shot a man several times with a traumatic pistol. According to the journalist, he did this due to aggression from a stranger. This incident became the reason for the criminal prosecution of Shariy.

That same year, the journalist was actively involved in investigating corruption in the Ministry of Internal Affairs. He pays special attention to the problems of drug trafficking and its patronage by the police. Also, many central Ukrainian channels showed a story about the closure of an underground casino by journalists, among whom was Shariy Anatoly. From this moment the real persecution begins. The criminal case regarding the shooting at McDonald's is being reinstated. Anatoly's mobile phone receives threatening calls. On July 12, people shoot at his car. The Ministry of Internal Affairs claims that it was staged and cites a number of very dubious evidence. The case is gaining resonance; not only the capital’s security forces are involved, but also the President of Ukraine Viktor Yanukovych.

Flight to the European Union

Constant pressure and fears for his life forced the journalist to leave for the European Union. Presumably, using someone else's documents, he was able to move to Russia, and from there to Latvia, where he asked for political refugee status, which EU representatives approved. Since then, Anatoly has been permanently residing in Europe.
